Circumstances That Should Prompt You to Call Smiley Law Firm About a Laplace Personal Injury Attorney

There are countless reasons to call Smiley Law Firm. You may need a case review, advice, legal services, or some combination of these services. There are even more specific reasons to speak with our team, which may include the following:

If you suffered any form of harm that you believe was someone else’s fault, we want to hear from you. Because our consultations are free, there is absolutely zero risk in making the call.

When Negligence Harms You, Smiley Law Firm Makes It Right

Negligence refers to a failure to act reasonably. Negligence is the inciting action for most car accidents, boat accidents, medical malpractice, and other events that lead clients to reach out to Smiley Law Firm.

We want to speak with you to determine if you are a victim of negligence. We will employ the negligence test, which generally determines you have a case if:

  • An at-fault party owed you a duty of care: Those with a duty of care have a legally binding responsibility to be reasonable. A motor vehicle operator, for example, has a duty to obey the speed limit and maintain a safe distance. It may be fairly easy to prove that the party at fault for your damages owed you a duty of care.
  • The at-fault party violated their duty: It may be more challenging to prove that the at-fault party violated their duty of care, but that’s what we will aim to do. As an example, we might use video footage to show a motorist tailgating your vehicle, which would be a violation of their duty of care.
  • The violation caused a harmful event (or series of events): We will need to prove a link between the at-fault party’s violation of their duty of care and the event or events that caused you harm. For example, we might establish that a medical provider failed to warn you of the risk of a specific procedure. If you subsequently suffered harm during that procedure, we would show that the doctor’s failure to warn exposed you to and ultimately caused harm.
  • You have suffered identifiable damages because of the violation: Clients typically come to us because they’re suffering damages. It might include severe pain, loss of income, medical costs, and other economic and non-economic damages. These damages are proof that an at-fault party’s negligence had harmful effects on the victim.

Getting justice for victims of negligence is the most fulfilling aspect of our job. In fact, it is our job. We hope you will allow Smiley Law Firm to perform our duty to you, as we will work hard to secure all the compensation to which you are entitled.

Why Countless Clients in Laplace Are Grateful They Chose Smiley Law Firm

Smiley Law Firm does not serve Arizona, New York, Florida, or Nevada. We serve Mandeville, New Orleans, and Metairie. We believe there are several advantages in focusing so intently on these three communities, as we:

  • Are solely focused on Louisiana law, which we believe makes us better able to use that law to our client’s advantage
  • Have offices in the communities we serve, which heightens our connection to clients and enables us to resolve cases right away
  • Maintain relationships with high-value experts in the greater New Orleans area, and these experts routinely add value to our personal injury cases (including those in Laplace)
  • Are intimately familiar with the communities we serve, including Laplace, and this benefits us when gathering evidence, meeting with clients, and handling many other case-related duties

We also have experience leading civil cases in St. Tammany Parish’s courts. While we are local, we offer the kinds of resources and high-caliber representation you might expect from a larger firm.

We want to point out a few more reasons to choose your Laplace personal injury attorney from Smiley Law Firm:

  • A collaborative team working together for you: As the Cajun Navy and countless other examples have shown, Louisianans understand the power of banding together in times of need. Smiley Law Firm embraces this spirit of teamwork by assembling an entire team around our clients. Your lawyer will lead the way, but you can expect assistance from paralegals and other support staff.
  • The endorsement of our former clients: Pay close attention to how former clients speak about a law firm. Smiley Law Firm’s former clients give us overwhelmingly positive reviews, attesting that we’re a hardworking, respectful, and results-oriented team of legal professionals.
  • The will to fight for you, including going to trial: Don’t let our polite demeanor fool you. The Laplace personal injury lawyers at Smiley Law Firm are fighters. When insurance companies and other liable parties give us a reason to do so, we get aggressive on our client’s behalf. Our team is willing to take cases to trial because we do what our clients need us to.
  • A depth of knowledge and experience in many personal injury case types: Personal injury law is a relatively broad field, and it’s one that we know well. We handle case types that we have experience in and are confident handling. Because we have dedicated ourselves to serving victims of negligence like you, we have accumulated many years of relevant experience that benefits us in our casework.

Our team serves Laplace daily. We care about this community and our clients. When you speak with our team members, you will see fellow Louisianans and the genuine care and concern that Louisianans are known for.

What Does a Personal Injury Case Look Like? (Remember, We Will Handle It)

No two personal injury cases look exactly alike. Even two car accident victims injured in the same type of collision in Laplace might have vastly different experiences. This is why our lawyers’ dynamic skills and varied experience are so valuable to our clients.

There are some common responsibilities that our personal injury lawyers must generally handle for clients, which include the following:

Advising the Client Throughout the Case

We are here for you. You cannot use your attorney enough, as it’s our job to:

  • Answer your questions
  • Address your concerns
  • Proactively inform you of case updates and upcoming developments
  • Ease your mind
  • Be your support system throughout your case

Client service is just as important to us as our legal work. When you hire Smiley Law Firm, you have a family.

Rebuffing Bad-Faith Tactics

We must be on guard when leading personal injury cases. Insurance companies and other liable parties may:

  • Allege that you are responsible for your damages
  • Deny your claim
  • Delay your claim
  • Extend lowball offers
  • Engage in many other bad-faith tactics

These tactics can work, especially for those who do not hire a personal injury attorney to protect them. Don’t let them work on you, as the consequences of accepting a denial or lowball settlement can be devastating.

Managing All Communications

We want you to be focused on your recovery. Let us handle all case-related communication for you.

There is also the risk that a single misspoken word or lighthearted comment may be used against you. Let us be the barrier between you and those who want the worst for your case.

Using Evidence of Negligence to Prove Fault

Each case we handle presents us with unique evidence. In every case, though, we must immediately secure evidence of negligence. Waiting can mean losing important pieces of your case, so don’t wait to contact Smiley Law Firm.

Documenting the Client’s Damages

Some of the most common ways we document clients’ damages are with:

  • The client’s testimony about their economic and non-economic damages
  • Doctors’ testimony and records detailing physical injuries and pain
  • Mental health professionals’ evaluations and testimony about pain and suffering
  • Medical bills
  • The client’s financial records detailing out-of-pocket costs, lost income, and other economic losses

We account for everything. When we present our demands to liable parties, we will leave no doubt about the harm you have suffered and how much you deserve for your damages.

Securing a Settlement or Taking Further Legal Action

There are generally two ways to resolve personal injury cases. We either secure a fair settlement or take our shot at trial. If we s\ucceed at trial, our client receives a judgment from the finder of fact (typically a judge or jury).

There will be other case-related responsibilities. Let us handle them. Be with those who care about you, follow your doctor’s orders, and get rest as we focus on instilling justice.

Damages We Include in Many Personal Injury Cases

We have never seen two clients who had the exact same damages. This is why we are so eager to speak with you. We need to find out exactly what harm you’ve suffered and how much compensation you deserve for those damages.

Some possible damages in a personal injury case are:

  • Medical costs, which may come from services provided by STHS Mandeville Emergency Department, Lakeview Hospital, or any other medical providers you see due to injury or illness
  • Pain and suffering, which may refer to acute and chronic pain, physical discomfort, scarring and other types of disfigurement, anxiety, depression, post-traumatic stress disorder (PTSD), and certain other non-economic harm
  • Professional damages, which can include lost earnings, diminished earning capacity, and any other harm to your career and ability to earn a living
  • Property damage, which we see often in auto accident cases and certain other case types

We also represent clients struggling with disabling injuries and illnesses and wrongful deaths. Compassion is central to our service, so you can trust Smiley Law Firm no matter what you’re going through. We will support you while demanding justice for the harm you’ve endured.

Smiley Law Firm Frees You to Focus on the Priorities That Require Your Attention

While we handle every possible aspect of our personal injury cases, we consider our relationship with clients to be a partnership. While we take care of your case, we want you to:

  • See your medical providers as often as they (or you) deem necessary
  • Prioritize the recovery process
  • Get any mental health services that promote healing
  • Engage in low-risk activities that bring you joy and fulfillment
  • Look out for our communications and contact us whenever you feel necessary

No victim should have to face the stress of a personal injury case. Let us help.

Laplace Personal Injury FAQs

How long do I have to file a claim in Louisiana?

The statute of limitations for personal injury claims in Louisiana is two years. You must contact a personal injury lawyer as soon as possible to ensure you file on time and protect your rights. If you miss the deadline, you may have no recourse to obtain the damages you deserve.

Louisiana’s comparative negligence law determines how fault affects your compensation after an accident.

Current Rule (through December 31, 2025): Louisiana follows pure comparative fault. You can recover damages even if you’re mostly at fault—your compensation is reduced by your percentage of fault. For example, if you’re 70% at fault, you can still recover 30% of your damages.

New Rule (effective January 1, 2026): Louisiana shifts to modified comparative fault under Act 15 of 2025:

  • If you’re 51% or more at fault, you cannot recover any damages
  • If you’re 50% or less at fault, you can recover damages reduced by your percentage of fault

Louisiana doesn’t regulate the amount you can receive in an injury claim unless the claim is for medical malpractice. Your attorney must account for all your economic and non-economic damages so you can recover the full amount you’re owed.

It depends. Although we try to settle most cases before trial, we may have to take your case to court if the defendant refuses to offer you the settlement you deserve.

A contingency fee is a method of payment that doesn’t require you to pay upfront for legal services. Our attorney fees are contingent upon us recovering compensation for you. We’ll discuss the contingency fee before moving forward with your case. This fee is usually a percentage of the settlement or court award we obtain on your behalf. Once we successfully resolve your case, you’ll pay us the agreed-upon percentage.
